1. Who We Are

Work Safer Now ("we", "us", "our") provides a lone-worker safety application (the "App") used by employers to monitor the wellbeing of employees who work alone, in line with obligations under the Safety, Health and Welfare at Work Act 2005 and related Irish health and safety legislation.

For the purposes of GDPR, in most cases the employer who deploys Work Safer Now to its staff is the Data Controller, and Work Safer Now acts as a Data Processor on the employer's behalf. This policy explains how we collect and use personal data as part of providing the App and service.

2. What Personal Data We Collect

Depending on how your employer has configured the App, we may collect:

  • Account and profile data: name, employer/company, role, employee ID, contact details.

  • Location data: GPS location, either entered manually or logged via a location-specific QR code, and ongoing background location while a shift or check-in session is active.

  • Check-in and activity data: login/logout times, check-in timer status, acknowledgements, alerts raised, and escalation events.

  • Device data: device type, operating system, app version, and push notification tokens, used to deliver alerts reliably.

  • Communications data: any messages or information you provide when contacting our support or monitoring station, including during an emergency escalation.
     

We do not collect financial, health, or biometric data through the App.

3. Why We Collect This Data

We process personal data for the following purposes:

  • To allow a worker to log in and out of a shift or location, and to indicate whether they are working alone.

  • To run a check-in timer and confirm the worker's safety at set intervals.

  • To determine and share a worker's location with the monitoring station and, where configured, the employer, if a check-in is missed or an alert is raised.

  • To escalate an alert to our 24/7 monitoring station and, where necessary, to emergency contacts or emergency services, so assistance can be sent to the worker's location.

  • To help employers meet their legal duty of care and health and safety obligations to lone workers.

  • To maintain, secure, and improve the App and investigate technical issues.

4. Legal Basis for Processing

We (and the employers we work with) rely on the following legal bases under GDPR:

  • Legitimate interests — protecting the health, safety, and welfare of workers, and enabling employers to meet their duty of care.

  • Legal obligation — compliance with health and safety legislation.

  • Vital interests — where location data is used to respond to a genuine emergency.

  • Consent — for optional features, where applicable, and background location permissions on the device, which the user grants directly through their phone's settings.

5. Background Location Access

The App requests background location access so that a worker's location is available to the monitoring station during an active, logged-in shift, including when the phone is locked or another app is in use. Location is only tracked while a worker is actively logged into a shift session; it is not tracked when the worker is logged out or has no active session.

6. Who We Share Data With

We share personal data only where necessary, with:

  • The employer who deploys the App to their staff, for oversight of health and safety obligations, timer/check-in status, and incident records.

  • Our 24/7 monitoring station, to respond to missed check-ins or raised alerts.

  • Emergency services or emergency contacts, where an alert indicates a worker may need urgent assistance.

  • Service providers who support our infrastructure (e.g. hosting, push notifications), under confidentiality and data processing agreements.
     

We do not sell personal data, and we do not share data with advertisers.

7. Data Retention

We retain check-in, location, and alert data only for as long as necessary to support the safety service and to allow employers to meet their record-keeping obligations under health and safety law, typically for a period defined in our agreement with each employer. Data is deleted or anonymised once it is no longer required for these purposes, unless a longer period is required by law.

8. Data Security

We use appropriate technical and organisational measures, including encryption, access controls, and secure hosting, to protect personal data against unauthorised access, loss, or misuse.

9. International Transfers

Where personal data is processed or stored outside the European Economic Area (EEA), we ensure appropriate safeguards are in place, such as Standard Contractual Clauses, to protect that data in line with GDPR requirements.

10. Your Rights

Under GDPR, you have the right to:

  • Access the personal data we hold about you.

  • Request correction of inaccurate data.

  • Request erasure of your data, subject to our safety and legal record-keeping obligations.

  • Object to or restrict certain processing.

  • Request data portability, where applicable.

  • Withdraw consent at any time, where processing is based on consent (such as device location permissions, which can be changed in your phone settings).
     

Because your employer is typically the Data Controller, some requests may need to be directed to your employer in the first instance. You may also contact us directly at dataprotection@worksafernow.ie and we will assist or direct your request accordingly.

You also have the right to lodge a complaint with the Irish Data Protection Commission (DPC) at www.dataprotection.ie, or with your local supervisory authority if you are based elsewhere in the EEA.

11. Children's Privacy

The App is intended for use by employees of client organisations and is not directed at children. We do not knowingly collect personal data from individuals under 18.

12. Changes to This Policy

We may update this policy from time to time to reflect changes in our practices or legal requirements. The "Last updated" date at the top of this page will always reflect the most recent version. Continued use of the App after changes take effect constitutes acceptance of the updated policy.
